Terms of Service

1. Acceptance of Terms

By accessing or using Collectimate.io ("the Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. These Terms constitute a legally binding agreement between you ("User" or "Client") and FYD Technologies OPC, the company that owns and operates the Collectimate platform.

If you do not agree to these Terms, you must not access or use the Platform.

2. Description of Services

Collectimate is an AI-powered conversational data collection platform that enables businesses to conduct high-volume outbound voice calls and two-way SMS conversations to gather, validate, and structure real-world data. Features include campaign configuration, AI voice agents, intelligent SMS workflows, real-time data extraction, dashboards, and API/export capabilities.

3. Eligibility

You must be at least 18 years of age and legally authorized to enter into binding contracts to use the Platform. By using Collectimate, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

4. Client Responsibilities

As a Client, you agree to:

• Use the Platform only for lawful purposes and in compliance with all applicable laws, including Philippine telecommunications regulations and the Data Privacy Act of 2012.
• Obtain all necessary consents from individuals prior to initiating AI calls or SMS contacts on their behalf.
• Not use the Platform to harass, deceive, or harm individuals.
• Not attempt to reverse-engineer, copy, or resell the Platform or any part of its technology.
• Maintain the security of your account credentials and promptly notify us of any unauthorized access.
• Comply with all campaign configurations and guidelines provided by FYD Technologies OPC.

5. Acceptable Use Policy

The Platform must not be used for:

• Spam, phishing, or unsolicited commercial communications.
• Collection of data for illegal purposes or without proper legal basis.
• Campaigns targeting minors without parental consent.
• Activities that infringe on intellectual property rights of third parties.
• Transmission of malware, viruses, or any harmful code.

Violation of this policy may result in immediate suspension or termination of your account, without refund.

6. Intellectual Property

All technology, software, trademarks, trade names, content, and materials comprising the Collectimate platform are the exclusive property of FYD Technologies OPC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for its intended purpose during the term of your agreement.

Data collected through campaigns on your behalf ("Campaign Data") remains your property. You grant FYD Technologies OPC a limited license to process and store such data solely to provide the services.

7. Payment and Billing

Pricing is determined on a per-engagement basis as agreed between you and FYD Technologies OPC. All fees are non-refundable unless otherwise stated in a written agreement. FYD Technologies OPC reserves the right to modify pricing upon reasonable notice.

8. Service Availability

We strive to maintain platform uptime and reliability but do not guarantee uninterrupted availability. Scheduled maintenance, force majeure events, or technical issues beyond our reasonable control may cause temporary service interruptions. FYD Technologies OPC shall not be liable for losses arising from such interruptions.

9. Limitation of Liability

To the fullest extent permitted by law, FYD Technologies OPC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the total fees paid by you to FYD Technologies OPC in the three (3) months preceding the claim.

10. Termination

Either party may terminate the agreement with written notice as specified in the applicable service agreement. FYD Technologies OPC may terminate or suspend access immediately for material breach of these Terms. Upon termination, your license to use the Platform ceases and we may delete Campaign Data after a grace period, unless otherwise agreed.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from or related to these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to the appropriate courts of Quezon City, Philippines, which shall have exclusive jurisdiction.

12. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated with at least 15 days' notice. Continued use of the Platform after the effective date of changes constitutes your acceptance of the revised Terms.
